The
International Registry
The Cape
Town Convention created the International Registry for
International Interests in Mobile Assets (Aircraft
Equipment) (the “IR”). The IR was activated on March
1, 2006. It is located in Dublin, Ireland; its supervising
authority is ICAO (International Civil Aviation
Organization) located in Montreal, Canada, and interests
registered there in U.S. registered aircraft must first go
through the FAA in Oklahoma City. By U.S. Declaration to
the Cape Town Treaty the Oklahoma City FAA is designated as
the filing portal to the IR for U.S. registered aircraft.

Dealing
with the Cape Town Convention and the registration of
“international” interests has changed the way we think and
has made the aviation sales and finance industries look at
transactions in a new way. The fact that a
transaction is wholly domestic does not change the fact that
the “international” interests must be registered at Cape
Town if the following apply: |
(a)
The equipment is defined as an “Aircraft Object”
and
(b) The aircraft is U.S. Registered or the debtor is
situated in a country that has ratified the Convention
and
(c) The interest is a Registerable interest
Definitions:
“Aircraft
Object”
Aircraft type-certificated to carry 8 persons, including
crew*; Helicopters type-certificated to carry 5 persons,
including crew**;
and Aircraft Engines of 550 rated take-off shaft horsepower
or more or Jet engines of 1750 pounds of thrust or more
*or type-certificated to transport goods in excess of
2750 kg (6063 pounds)
**or type-certificated to transport goods in excess of 450
kg (990 pounds)
“International
Interest”
A present or prospective
security agreement, a present or prospective conditional
sale contract (title retention contract), a present or
prospective financing or true lease, or assignment or
subrogation of one of the foregoing interests.

TUE –
Transacting User Entity (a buyer, seller, lessor, lessee or
lender, or a prospective buyer, seller, lessor, lessee, or
lender, or assignee or subrogee of any of the foregoing)
PUE -
Professional User Entity (A title company or law firm)
